Terms of Service

1. Acceptance of Terms

By accessing or using LegalWillsJamaica (“the Platform”), you acknowledge and agree to be bound by these Terms of Service. If you do not agree, you must immediately discontinue use of the Platform. Continued use constitutes ongoing acceptance of these Terms.

2. Services Provided

LegalWillsJamaica is a self-directed online platform designed to assist users in drafting Last Wills and Testaments.

  • No Legal Advice: The Platform does not provide personalized legal advice, opinions, or representation.
  • Drafting Tool: The Platform generates draft Wills using standardized templates vetted for general compliance with Jamaican law.
  • Validity Requirements: Draft Wills are not legally binding until executed in accordance with the Wills Act of Jamaica, including proper signing by the Testator and two witnesses.
  • User Responsibility: Users are solely responsible for ensuring compliance with all legal requirements and for the accuracy of the information provided.
  • Risk Acknowledgment: Use of the Platform is entirely at your own risk. You are strongly encouraged to consult a licensed attorney for advice on converting your draft into a legally binding Will, especially in cases involving complex estates, foreign property, or special circumstances.

3. Eligibility

4. Account Responsibility

You are solely responsible for:

  • Maintaining the confidentiality of your login credentials.
  • All activity conducted under your account.
  • Promptly notifying LegalWillsJamaica of any unauthorized access or security breach.

5. Subscriptions and Access

  • Subscription plans (three months, six months, one year) grant access to create, edit, and update your Will during the subscription period.
  • After expiry, your Will remains viewable and printable but cannot be edited unless renewed.
  • Subscription fees cover platform access only and do not guarantee legal validity or outcomes.

6. Intellectual Property

All content, branding, software, templates, and documentation are the exclusive property of LegalWillsJamaica. You may use the Platform solely for personal Will preparation. Unauthorized reproduction, distribution, or commercial use is strictly prohibited.

7. Third-Party Links and Services

LegalWillsJamaica may provide links to third-party service providers, including attorneys or other professionals.

  • Separate Contracts: Any engagement with such third-party providers constitutes a separate and independent contract between you and the provider.
  • No Affiliation: These services are not part of, nor included in, your subscription with LegalWillsJamaica.
  • No Liability: LegalWillsJamaica assumes no responsibility or liability for the acts, omissions, or services of third-party providers.

8. Ownership of Platform and Brand

The website and brand LegalWillsJamaica.com are owned and operated by Innovative Growth Organizers Limited. By using the Platform, you acknowledge that your contractual agreement is with Innovative Growth Organizers Limited, the legal entity responsible for providing the Service.

9. User Conduct Policy

By using the Platform, you agree to act responsibly and lawfully. Prohibited activities include, but are not limited to:

  • Providing false, misleading, or incomplete information.
  • Attempting to gain unauthorized access to the Platform or other users’ accounts.
  • Using the Platform for fraudulent, abusive, or unlawful purposes.
  • Sharing, reselling, or redistributing Platform content, templates, or intellectual property without authorization.
  • Uploading or transmitting malware, viruses, or harmful code.
  • Engaging in conduct that disrupts or interferes with the Platform’s operation or other users’ experience.

Violation of this User Conduct Policy may result in immediate suspension or termination of your account, without refund, and may expose you to civil or criminal liability under Jamaican law.

10. Limitation of Liability

To the fullest extent permitted by Jamaican law:

  • LegalWillsJamaica, its owners, employees, and affiliates disclaim all liability for direct, indirect, incidental, consequential, punitive, or special damages arising from or connected to your use of the Platform.
  • Your sole and exclusive remedy is to discontinue use of the Service.

11. Indemnification

You agree to indemnify and hold harmless LegalWillsJamaica, its owners, employees, affiliates, and contractors against any claims, damages, liabilities, costs, or expenses (including legal fees) arising from:

  • Your use of the Platform.
  • Errors or omissions in your inputs.
  • Technical failures, malware, viruses, or printing errors.
  • Any breach of these Terms.

12. No Warranties

The Platform is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to accuracy, merchantability, fitness for a particular purpose, or non-infringement.

13. Force Majeure

LegalWillsJamaica shall not be liable for delays or failures caused by events beyond its reasonable control, including natural disasters, technical failures, cyberattacks, or government actions.

14. Governing Law

These Terms are governed by the laws of Jamaica. Any disputes shall be resolved exclusively in the courts of Jamaica.

15. Severability

If any provision is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Jurisdiction & Dispute Resolution

  • Initial Resolution: In the event of any dispute, claim, or controversy arising out of or relating to your use of the Platform, you agree to first attempt to resolve the matter informally by contacting LegalWillsJamaica in writing.
  • Mediation: If the dispute cannot be resolved informally within thirty (30) days, the parties agree to submit the matter to mediation before a mutually agreed mediator in Kingston, Jamaica.
  • Arbitration: If mediation fails, the dispute shall be finally resolved by binding arbitration under the Arbitration Act of Jamaica. The arbitration shall be conducted in Kingston, Jamaica, in English, by a single arbitrator appointed in accordance with the rules of the Jamaican Arbitration Centre.
  • Court Proceedings: Notwithstanding the above, either party may seek interim or injunctive relief in the courts of Jamaica to protect its rights pending arbitration.
  • Exclusive Jurisdiction: Subject to the arbitration provisions above, you agree that any legal proceedings shall be brought exclusively in the courts of Jamaica.
  • Costs: Each party shall bear its own legal costs and all costs related of mediation and arbitration, except as otherwise determined by the mediator or arbitrator.

Refund Policy

  • Eligibility: Refunds are available only within 2 days of purchase and only if no completed Will has been generated.
  • Non-refundable: Once a Will has been generated, or after 2 days form the start of subscription, your subscription fees are strictly non-refundable.
  • Access Fees: Payments are for platform access, not for legal advice or guaranteed results.
  • Renewals: Renewals are voluntary; no automatic charges will be made.
  • Processing: Approved refunds will be processed via the original payment method within 14 business days.

Data Protection & Privacy Policy

1. Collection of Data

We collect personal details necessary to generate your Will (e.g., name, date of birth, address, beneficiaries, executors, assets).

2. Use of Data

Your data is used solely for providing the Service and managing subscriptions. We do not sell, trade, or monetize your data.

3. Storage & Security

Data is stored with reasonable administrative, technical, and physical safeguards. However, no system is entirely secure. You acknowledge that you provide information at your own risk.

4. Sharing of Data

We will not disclose your data without your authorization, except where required by law. You are responsible for safeguarding your login credentials.

5. Retention

Your account and Will remain accessible indefinitely unless you request deletion. Deleted accounts are permanently erased subject to applicable law.

6. Limitation of Liability

We are not liable for unauthorized access, loss, or disclosure of data caused by third parties, user negligence, or events outside our control.

7. Your Rights

You may request access to or deletion of your personal data, subject to applicable law. Requests may be denied if deletion conflicts with legal obligations.
