Terms of Service
1. Acceptance of Terms:
By accessing and using LegalWillsJamaica, you agree to these Terms of Service. If you do not agree, you must not use this platform.
2. Services Provided:
LegalWillsJamaica provides a self-directed online platform for drafting Last Wills and Testaments. We do not provide personalized legal advice or representation. The platform is a general use tool that allow users to structure the distribution of their assets in the format of a legal Last Wills and Testament. The format is approved for use by our attorneys but these draft Wills are not valid legal Last Will and Testament until all the requirements of a valid will is completed and the Will is properly signed by the Testator and 2 witness in accordance with the Wills Act of Jamaica. It is the users’ responsibility to ensure that the will is completed properly and assets are distributed properly according to the Testator’s wishes. Your use of the Service assumes you are fully aware of the requirements of the Wills Act of Jamaica and you are using the platform entirely at your own risk. You should contact your attorney to advise you on how to convert your draft will into a legally binding Last Will and Testament.
3. Eligibility: You must be at least 18 years old and legally capable of entering into binding contracts to use this website.
4. Account Responsibility: You are solely responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account.
5. Subscriptions and Access: Subscription plans (three months, six months, one year) grant you access to create, edit, and update your Will during the subscription period. After expiry, your Will remains viewable and printable, but not editable unless renewed. Access fees are for platform usage only and do not guarantee any outcome.
6. Intellectual Property: All website content, branding, code, and templates are the exclusive property of LegalWillsJamaica. You may use the platform solely for personal Will preparation.
7. Limitation of Liability: To the fullest extent permitted by Jamaican law, LegalWillsJamaica, its owners, employees, and affiliates disclaim all liability for direct, indirect, incidental, consequential, punitive, or special damages arising from or connected to your use of the Service. Your sole and exclusive remedy is to discontinue using the Service.
8. Indemnification: You agree to indemnify, defend, and hold harmless LegalWillsJamaica, its owners, employees, affiliates, and contractors from and against any and all claims, damages, liabilities, costs, or expenses (including legal fees) arising out of your use of the Service, your inputs, or any breach of these Terms. You understand that digitally created documents my have errors and agree to hold harmless LegalWillsJamaica for any errors or omissions however caused including but not limited to incorrect user inputs, software errors, malware, virus, printing errors, technical failures, etc. LegalWillsJamaica shall not be liable for any damages whatsoever arising out of the use of the platform.
9. No Warranties: The Service is provided on an ‘as is’ and ‘as available’ basis without warranties of any kind, whether express or implied, including warranties of accuracy, fitness for a particular purpose, merchantability, or non-infringement.
10. Force Majeure: We are not liable for any delay or failure due to causes beyond our reasonable control, including but not limited to natural disasters, technical failures, or government actions.
11. Governing Law: These Terms are governed by the laws of Jamaica, and any disputes shall be resolved exclusively in Jamaican courts.
12. Severability: If any provision is found invalid, the remaining provisions remain enforceable.

The Service is a self-directed platform where you input your own information to generate a Will using standardized templates vetted for general compliance with Jamaican law. Your use of this Service does not create a solicitor-client relationship. You acknowledge that you are solely responsible for the accuracy and completeness of the information you provide. You are strongly encouraged to seek independent legal advice if your estate is complex, involves foreign property, or includes special circumstances.
Refund Policy
Eligibility: Refunds are available only within 7 days of purchase and only if you have not generated a completed Will.
Non-refundable: Once a Will has been generated, or after 7 days, subscription fees are strictly non-refundable regardless of circumstances.
Access Fees: Subscription payments are fees for access to the platform and services. They are not payments for legal advice or guaranteed results.
Renewals: Renewals are entirely voluntary; no automatic renewal charges will be made.
Method: Approved refunds (where applicable) will be processed via the original payment method within 14 business days.
Data Protection & Privacy Policy
1. Collection of Data: We collect personal details necessary to generate your Will (e.g., name, date of birth, address, beneficiaries, executors, assets).
2. Use of Data: Your data is used solely for providing the Service and managing subscriptions. We do not sell or trade your data.
3. Storage & Security: Data is stored using reasonable administrative, technical, and physical safeguards. However, no system is entirely secure. You acknowledge that you provide information at your own risk.
4. Sharing of Data: We will not disclose your data without your authorization, except where required by law. Passcode sharing is your responsibility.
5. Retention: Your account and Will remain accessible indefinitely unless you request deletion. Deleted accounts are permanently erased subject to applicable law.
6. Limitation of Liability: We are not liable for any unauthorized access, loss, or disclosure of data caused by third parties, user negligence, or events outside our control.
7. Your Rights: You may request access to or deletion of your personal data, subject to applicable law. Requests may be denied if deletion would conflict with legal obligations.
